1.Overview.The Rentility™ Rewards Program (“Rewards Program”) is a service offered
by Rentility LLC (“Rentility™,” “we” or “us”). The Rewards Program is available
to lessors that have registered with Rentility™ (“Registered Lessors”) by
submitting an online registration form (“Registration Form”) through the
Rentility™ website at http://www.rentility.com
(the “Site”).By enrolling in the
Rewards Program, you agree to comply with and be bound by these Rewards Program
Terms and Conditions, as well as the Rentility Privacy Policy, Rentility™
Lessor Agreement and all other applicable Rentility™ operating rules, policies,
price schedules and other supplemental terms and conditions or documents that
may be published from time to time (collectively, the “Agreement”).Any failure to abide by the Agreement, any
abuse of privileges, any conduct detrimental to the interests of Rentility™, or
any misrepresentation of any information furnished to Rentility™ by any
Registered Lessor, or anyone else acting on the Registered Lessor’s behalf, may
result in deactivation from the Rewards Program, the cancellation of accrued
Points or Rewards, or both (as those terms are defined below).
2. Eligibility
and Enrollment.All Registered
Lessors in good standing are
eligible for enrollment into the Rewards Program.You will be automatically enrolled in the
Rewards Program upon activation of your Lessor account (“Lessor Account”).Notwithstanding the foregoing, Rentility™
may, for any or no reason whatsoever, in its sole discretion, deny any request
for enrollment into the Rewards Program.
3. Earning Points.The earning and accumulation of Rewards
Program “points” (“Points”) begins once you are enrolled in the Rewards
Program.You will not, under any
circumstances, earn Points before being enrolled in the Rewards Program.
For each rental
transaction that takes place though the Site, Rentility™ will award Points to a
Registered Lessor at the rate of one (1) Point per each night that a lessee
that is registered with the Site (“Registered Lessee”) rents a Registered
Lessor property listed on the Site (“Property”).Some rental transactions may, at
Rentility™’s sole discretion, be excluded from eligibility for accrual of
Points.
Points will be
calculated upon completion of the applicable rental transaction and not at any
prior point, including during the bidding process.The calculation of Points earned by any
Registered Lessor will be made solely and exclusively by Rentility™.Rentility™ will use reasonable efforts to
calculate and upload the Registered Lessor’s earned Points to the Registered
Lessor’s Account within seventy-two (72) hours after the applicable rental
transaction is completed.
The Points that each Registered Lessor
accrues do not constitute the property of the applicable Registered Lessor and
are, and will remain, the exclusive property of Rentility™. Registered Lessors
cannot transfer Points between separate Lessor Accounts or to other Registered
Lessors.Points earned in two (2) or
more different Lessor Accounts may not be combined for redemption.Points have no monetary value except to the
extent specifically provided for by Rentility™ within these Rewards Program Terms
and Conditions.The accumulation of
Points does not entitle the Registered Lessor to any vested rights with respect
to any Reward or the Rewards Program.
Points will not expire except in the event
of deactivation or termination from the Rewards Program as described in the
below section “Termination of Program,” or in the event of termination of the
Registered Lessor’s Account as set forth in Section 5 of the Rentility™ Lessor
Agreement.
Rentility™ reserves the right to audit any
and all Registered Lessor accounts at any time for compliance with these
Rewards Program Terms and Conditions, without notice to the Registered
Lessor.In the event that an audit
reveals discrepancies or possible violations, the processing of a Reward
request may be delayed pending completion of the applicable audit.
4. Claiming a Reward
i.Points
earned through the Rewards Program may be redeemed for a cash reward (“Reward”)
upon the accumulation of at least One Hundred and Fifty (150) points
(“Threshold Amount”).
ii.Rewards will be calculated at a rate of One
Dollar ($1.00) for every Four (4) Points earned.
iii.When the Registered Lessor has obtained a
sufficient number of Points, the Registered Lessor may request a Reward from
Rentility™ through the “Redemption” option available via Registered Lessor
Account interface.
iv.When requesting a Reward, the Registered
Lessor will be able to select whether he/she/it would like to receive
his/her/its Reward by check or by having the Reward deposited into the PayPal®
account provided during the enrollment process.Checks will be mailed to the address indicated in the Registered Lessor
profile at the time of redemption.If
any of the information supplied as part of the Registered Lessor's Registration
Form changes, at any time, the Registered Lessor must immediately inform
Rentility™ of same to reflect such changes in his/her/its Registered Lessor
Profile.Rentility™ shall not be
responsible for a Registered Lessor's failure to provide notification of any
such changes in a timely manner.
v.Rewards will be issued to eligible
Registered Lessors within fourteen (14) days of Rentility™ receiving the
applicable redemption request.
vi.Reward offers are subject to change or
cancellation without notice.Registered
Lessors may not rely upon the continued availability of any Rewards Program
Point structure.The Rewards Program
Point structure is subject to modification, cancellation or limitation in
Rentility™’s sole discretion, with or without notice.The Threshold Amount required to redeem any
Reward may be substantially increased or decreased, any Reward may be
withdrawn, and restrictions on any Reward or its redemption may be imposed, at
any time.
vii.Taxes and fees related to any Reward are
the responsibility of the applicable redeeming Registered Lessor.
5. Statements of Reward Points Earned.Registered Lessors shall have access to information regarding completed
rental transactions and Point balances via their Registered Lessor Account.Such information is provided by Rentility™ to
Registered Lessors for tracking purposes only and should not be relied upon by
Registered Lessors for its accuracy.Rentility™ shall have the right to make the final determination, at its
sole discretion, regarding any disputes that may arise regarding rental transactions
and Point balances.
6. Termination of Program.This Rewards Program and its benefits are being offered at the
discretion of Rentility™, and Rentility™ reserves the right to suspend or
terminate the Rewards Program and/or suspend or terminate any Registered Lessor’s
enrollment in the Rewards Program at any time for any or no reason whatsoever
without any prior notice to the applicable Registered Lessor.
If the Rewards
Program or a Registered Lessor’s enrollment is suspended or terminated (except
in the case of violation of the Agreement by the Registered Lessor), Points
will cease to accumulate on the date of suspension or termination and any
unredeemed Points must be redeemed within three (3) months of the date of such
suspension or termination.
If a Registered
Lessor’s enrollment in the Rewards Program is terminated or suspended as the
result of violation(s) of the Agreement by the Registered Lessor, Points will
cease to accumulate on the date of termination or suspension and any unredeemed
Points will be deemed cancelled.
7. Disclaimer.Rentility™hereby disclaims any
and all liability for any damages, injuries, losses, deficiencies, liabilities,
obligations, commitments, costs or expenses of any kind or nature (including
legal fees and other expenses) incurred by Registered Lessor relating to or
arising out of this Rewards Program.Any
access to and/or participation in the Rewards Program is undertaken at the
Registered Lessor's own risk as a participating Registered Lessor.
Participation in
the Rewards Program including, but not limited to, the accumulation of Points
and the redemption of Points is subject to these Rewards Program Terms and
Conditions and any other Rewards Program rules enacted by Rentility™.Each participating Registered Lessor is
responsible for reading these materials in order to understand its rights and
responsibilities under the Rewards Program.
Rentility™
reserves the right to change these Rewards Program Terms and Conditions at any
time without prior notice, even though changes may affect the value of Points
already accumulated. Rentility™ may, among other things: (i) withdraw, limit,
modify or cancel any Rewards Program offer; (ii) increase or decrease the
Threshold Amount required for redemption; (iii) modify or regulate the
transferability of any Reward; and/or (iv) modify the number and types of
Rewards available. Rentility™ expressly reserves the right to establish
additional means of accruing Points, to delete any or all of the means
currently recognized, or to exclude specific types of rental transactions that
result in the accumulation of Points. Rentility™ further reserves the right to
make “bonus” Points and promotional offers selectively available to certain
Registered Lessors at any time, based on rental activity, geographic location,
Rewards Program participation, or other factors determined at Rentility™’s sole
discretion.Registered Lessors should
periodically return to and review these Rewards Program Terms and Conditions
for any changes or modifications hereto.
All questions or
disputes regarding:(a) eligibility for
this Rewards Program; (b) the accumulation and redemption of Points; (c) the
availability of any Reward; and/or (d) other issues related to or arising out
of theses Rewards Program Terms and Conditions will be resolved by Rentility™
